800 families face eviction

MORE than 800 families at Kingsdale Farm in Norton are facing eviction after the owner went to the court seeking to eject them over purchase arrears.

According to the summons, the property owner Maparahwe Properties, has threatened to demolish the residents’ houses.
The property firm accuses the residents of breaching the agreement.

“Despite being given 30 days’ notice by plaintiff (Maparahwe) to rectify the said breach by paying the outstanding arrears, defendant has failed, refused and/or neglected to pay the said arrears.

“Plaintiff is therefore entitled in terms of the agreement to cancel the agreement of sale between itself and defendant,” one of the summons served on one of the residents read.

The firm is now demanding an order cancelling the agreements of sale it entered with the residents.

It further seeks the “Ejectment of defendant…and all those claiming occupation of same through defendant. An order that plaintiff be granted leave to demolish defendant’s structure at stand … Kingsdale, Norton. Costs of suit on a legal practitioner and client scale.”

The summons also added that failure to respond in seven days will see the residents evicted from the place.

“Take notice that, in default of your doing so you will be held to have admitted to the said claim and the plaintiff may proceed therein and judgment maybe given against you in your absence, but that on the payment of thus said claim and the costs, judgement will not be given against you herein and if before the expiration date of the said time you pay or lodge with me and the plaintiff or his legal practitioners a consent to judgement you will save judgment charges.

“If you allege any exception, defence or counter claim within seven (7) days after appearance deliver to the clerk of court and to the plaintiff or its legal practitioners a statement in writing of the nature and grounds thereof.”

According to Residents development committee chairperson Miriro Maphosa more than 800 families received the summons.—Blessings Mashaya
