96-year-old kills neighbour

A 96-year-old man has been caged nine years for shooting and killing a neighbour for ploughing what he claims was a way to his family’s grave yard.

High Court judge Justice Charles Hungwe however, spared Freddy Mukoka Chitange of Village 23, Chief Chikore in Mayo a lengthy sentence due to his advanced age.
Chitange was convicted for the murder of Silvestre Chimbende with actual intent.

The nonagenarian however, told the court that he only sought to incapacitate Chimbende so that he could take him to the police for reconciliatory talks when he shot him on the thigh.
Chimbende died of severe haemorrhaging from the thigh gunshot wound.

It was the State’s case that April 13, 2015 Chitange had shot Chimbende with a 303 rifle once on the right thigh as he ploughed his family field.

The now deceased then bled to death in the field.
Chitange then proceeded to the police to inform them of the murder of his neighbour.

On his way though, he met Chimbende’s friend Aleck Mwarusi who wanted to join his friend in the field whom he ordered to turn away confessing that he had shot him on the right thigh, saying “he would finish what he had started”.

In fear, he turned away only to see a police vehicle speeding to the field.

Chimbende’s mother Susan, who had left her son in the field to prepare food for the family was also shocked to see police going towards their field only to later be told that her son had been murdered by Chitange.

Medical doctor Trevor Mwaramba who conducted the post mortem testified that Chimbende died due to loss of blood.
